Are car accidents covered by workers’ compensation?

Workers’ compensation is a program that helps protect you and your employer in Pennsylvania. It helps ease the financial burdens that occur from an accident. One of the important things to remember about workers’ compensation is that this insurance applies only when you are on the job and doing work-related activities. This is important to understand when you look at whether it will cover an auto accident.

According to Employers, the circumstances of a car accident play completely into whether workers’ compensation covers it. Above all else, when you get into the accident, you have to be working. You need to be on the clock or doing a work activity, such as taking a deposit to the bank or delivering something to a customer. If you were working at the time, then it is usually going to be covered.

Where it may get confusing is if you are driving to and from work or to and from job locations. In general, workers’ compensation will not cover any accidents during your commute to and from work when you are going home or coming from home. This is not time you are on the clock. However, if you are commuting from one work location to another, you are on the clock and covered by the insurance.

Of course, there are always exceptions and workers compensation works differently than other insurance. Mainly, it does not matter who was at fault. Workers’ compensation will cover it regardless of fault if it is a qualifying accident. This information is for education and is not legal advice.
